Article 1 – Definitions

In these Terms of Service, the following definitions apply:

  • Cooling-off Period: The period within which the consumer can exercise their right of withdrawal.

  • Consumer: A natural person not acting for business purposes.

  • Ongoing Contract: A contract for a series of products or services over time.

  • Right of Withdrawal: The consumer’s right to cancel the agreement within the cooling-off period.

  • Entrepreneur: Olyx Fashion, offering products via distance selling.

  • Distance Contract: A contract concluded via online or remote communication.

  • CESOP: EU payment monitoring system.

Article 2 – Identity of the Entrepreneur

Article 3 – Applicability

These Terms apply to all offers, orders, and agreements between Olyx Fashion and the consumer.

If any provision is invalid, the remaining provisions remain in force. Any unclear situations will be interpreted in the spirit of these Terms.

Article 4 – The Offer

  • All offers are non-binding and subject to change.

  • Product descriptions and images are provided as accurately as possible, but may vary slightly in color or appearance.

  • Prices exclude customs duties and import VAT, which are the customer’s responsibility.

  • Shipping costs and terms will be clearly stated before checkout.

Article 5 – The Agreement

The agreement is concluded when the customer accepts the offer and completes payment.

Olyx Fashion reserves the right to refuse or cancel orders if necessary (e.g., suspected fraud or incorrect information).

Article 6 – Right of Withdrawal

Consumers have the right to withdraw from the purchase within 14 days of delivery.

Conditions:

  • Items must be returned unused and in original packaging

  • Return shipping costs are the customer’s responsibility

  • Defective items will be replaced or refunded

Certain items may be excluded (e.g., custom or hygiene products).

Article 7 – Costs in Case of Withdrawal

  • Return costs are borne by the consumer

  • Refunds will be processed within 14 days after receiving the return

Article 8 – Customs & Import Responsibilities

Customers are fully responsible for:

  • Import duties, VAT, and taxes

  • Customs clearance and fees

  • Compliance with local laws

Olyx Fashion is not liable for delays, seizures, or additional costs due to customs.

Article 9 – CESOP Compliance

We comply with EU regulations requiring transaction data reporting to CESOP.

Article 10 – Conformity & Warranty

  • Products must match their description

  • Defects must be reported within 14 days

  • Items must be returned in original condition

Article 11 – Delivery

  • Orders are shipped internationally

  • Delivery times may vary

  • Olyx Fashion is not responsible for delays caused by shipping carriers or customs

  • Failure to comply with import rules does not qualify for a refund

Article 12 – Complaints

  • Complaints must be submitted within 7 days

  • We respond within 14 days

Article 13 – Disputes

These Terms are governed by Dutch law. Disputes will preferably be resolved amicably.

Article 14 – Pricing

  • Prices may change due to legal or market conditions

  • No VAT is charged at checkout (import VAT may apply)

  • We are not liable for pricing errors

Article 15 – Legal Notice

Olyx Fashion operates as an independent reseller.
We are not affiliated with any brands referenced for style or inspiration.

All trademarks belong to their respective owners.

Article 16 – Payment

  • Payments must be completed at checkout

  • Customers must report payment errors immediately

  • Non-payment may result in order cancellation

Article 17 – Complaints Procedure

  • Complaints must be clearly described

  • If unresolved, disputes may proceed to legal resolution

  • Valid complaints may result in repair, replacement, or refund

Article 18 – Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our Services means acceptance of changes.
